Terms & Conditions.

These terms define the responsibilities, limitations and conditions applicable to services provided by Paper Mug Lab.

Acceptance of Terms

By accessing this website, requesting a service, purchasing a service, approving a project, or otherwise engaging with Paper Mug Lab, you agree to be bound by these Terms & Conditions.

If you do not agree with these terms, you should not use our services.

Services

Paper Mug Lab may provide services including, but not limited to:

  • Website design and development.
  • Web application development.
  • Mobile application development.
  • AI application development.
  • AI application fixing and support.
  • Code review and technical consulting.
  • UI / UX and product design.
  • Website and application maintenance.
  • Hosting and server services.
  • Server configuration and deployment.
  • Technical support and troubleshooting.

The exact scope of each engagement will depend on the agreed proposal, quotation, statement of work, project requirements, or other written agreement between the customer and Paper Mug Lab.

Customer Responsibility

Customers are responsible for providing accurate information, requirements, credentials, content, access and approvals necessary for the agreed services.

Customers are also responsible for ensuring that content, software, data, credentials, documents, images, code and other materials supplied to Paper Mug Lab may lawfully be used for the requested work.

Delays caused by missing information, unavailable access, delayed approvals, third-party dependencies or changes in requirements may affect project timelines.

Backups Are the Customer's Responsibility

Customers are responsible for maintaining current and reliable backups of their websites, applications, databases, files, source code, media, configurations and other important data.

Customers should maintain backups independently of Paper Mug Lab and should verify that those backups can be restored.

Unless a separate written agreement specifically states otherwise, Paper Mug Lab does not guarantee that a backup exists, that a backup is complete, or that a backup can be successfully restored.

Before requesting significant changes, migrations, updates, upgrades, server changes or application modifications, customers are strongly advised to create and verify a current backup.

Web & Application Development

Development work is performed according to the agreed project scope and available requirements.

Software may depend on operating systems, browsers, libraries, frameworks, plugins, APIs, hosting environments, third-party services and other technologies that are outside the direct control of Paper Mug Lab.

Paper Mug Lab does not guarantee that software will remain compatible with every future version of a third-party technology, operating system, browser, plugin, framework, API or external service.

Changes requested outside the agreed scope may require additional time, cost or a separate agreement.

Hosting & Servers

Where Paper Mug Lab provides hosting, server or infrastructure-related services, those services may depend on data centers, network providers, hardware, software, operating systems, cloud providers and other infrastructure outside our direct control.

Paper Mug Lab does not guarantee continuous or uninterrupted availability of any website, application, server, hosting environment or infrastructure.

Hardware failures, network failures, maintenance, software failures, operating system issues, data-center incidents, provider outages, DNS problems, attacks and other circumstances may result in temporary or extended service disruption.

Customers acknowledge that server and hosting services involve operational and technical risks.

Cybersecurity & Cyber Attacks

Paper Mug Lab takes reasonable measures appropriate to the services being provided to help maintain the security of websites, applications and infrastructure under its management.

However, no website, application, server, network, database, hosting environment or internet-connected system can be guaranteed to be completely secure.

Paper Mug Lab shall not be responsible for losses, damages, interruptions, data loss or unauthorized access resulting from cyber attacks or security incidents, including but not limited to:

  • Malware or malicious software.
  • Distributed denial-of-service (DDoS) attacks.
  • Brute-force attacks.
  • Credential compromise.
  • Phishing or social engineering.
  • Exploitation of previously unknown vulnerabilities.
  • Vulnerabilities in third-party software, plugins, libraries or APIs.
  • Attacks against infrastructure or external service providers.
  • Unauthorized access caused by customer-controlled credentials or systems.

Customers are responsible for maintaining secure passwords, access controls, authentication mechanisms and credentials associated with their systems.

Downtime & Service Interruptions

Paper Mug Lab does not guarantee that websites, applications or servers will remain available without interruption.

Downtime may occur because of planned maintenance, emergency maintenance, infrastructure failure, hardware failure, software errors, network problems, security incidents, cyber attacks, third-party service failures, DNS issues, hosting-provider problems or other circumstances beyond reasonable control.

Unless specifically agreed in a separate service-level agreement, no particular uptime percentage or recovery time is guaranteed.

Third-Party Services

Websites and applications may use services operated by third parties, including hosting providers, domain registrars, payment providers, APIs, cloud services, plugins, libraries, analytics services, communication platforms and other external providers.

Paper Mug Lab is not responsible for outages, changes, suspension, termination, pricing changes, limitations, security incidents or failures of third-party services.

Customers may be required to maintain their own third-party accounts, subscriptions, licenses and payment arrangements.

Customer Data & Content

Customers remain responsible for their website content, application data, customer records, uploaded files, databases, credentials and other information supplied to or stored within services provided to them.

Customers are responsible for ensuring that their data collection, storage, processing and use comply with applicable laws and regulations.

Customers should not provide sensitive information to Paper Mug Lab unless it is reasonably necessary for the agreed service and appropriate arrangements are in place.

Limitation of Liability

To the maximum extent permitted by applicable law, Paper Mug Lab shall not be liable for indirect, incidental, special, consequential or punitive losses or damages arising from or related to the use of its services.

This includes, without limitation, loss of revenue, loss of business, loss of opportunity, loss of profits, loss of data, loss of customers, business interruption, reputational damage or other consequential losses.

Paper Mug Lab shall not be responsible for losses arising from website downtime, application downtime, server downtime, cyber attacks, security incidents, data loss, unauthorized access, infrastructure failures or third-party service failures, except to the extent that such limitation is prohibited by applicable law.

Nothing in these terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

Indemnification

To the extent permitted by applicable law, the customer agrees to indemnify and hold Paper Mug Lab harmless from claims, losses, liabilities, damages and reasonable expenses arising from:

  • Customer-provided content or data.
  • Customer's misuse of the services.
  • Customer's violation of applicable laws.
  • Unauthorized use of customer accounts or credentials.
  • Customer's violation of third-party rights.

Termination

Either party may terminate a service engagement according to the applicable project agreement, proposal, subscription terms or other written arrangement.

Outstanding fees for services already provided or committed may remain payable following termination.

Upon termination, customers remain responsible for obtaining and maintaining their own copies of required website, application and data assets.

Changes to Services & Terms

Paper Mug Lab may modify, update, suspend or discontinue any service where reasonably necessary.

These Terms & Conditions may also be updated from time to time. The updated version will be published on this page with a revised "Last updated" date.
